We at Direct E-Cig strive to produce the best product and maintain the best customer service possible. We do however have certain guidelines and general practices that you should read and understand before purchasing our product(s).

Please read these terms carefully before you use the Direct E-Cig website (the "website"). In these terms, "we", "us" and "our" means Direct E-Cig and "you", "your", "buyer" and "customer" means the person using the website. By accessing and using the website, you agree to be legally bound by these terms. From time to time we may choose to amend these terms and may change these conditions at any time without notice. If you do not agree with these terms and conditions, please do not use our site.

Electronic Signature:

Whenever you visit Direct E-Cig.com, send an email, or login to our website, you are communicating to us electronically. If you chose to do so, you give Direct E-Cig.com the permission to reciprocate communication in the same electronic format either by email or notices on the site. You, the user, agree that all notices, agreements, disclosures, or contracts we provide electronically satisfy all legal requirements that communications must be in writing. You may send comments, ideas, questions, or other information as long as information is not illegal, threatening, misleading in any way, derogatory, or injurious to any party. You agree not to send software viruses, spam mail, chain mail, or anything unrelated to services or our products.

Adult Signature Required - Please Read:

We at Direct E-Cig are doing everything we can to prevent the consumption of our products by minors. One way of minimizing the chance of our product ending up in the hands of underage persons is to require an adult signature whenever our products are delivered to you. To ensure you receive your electronic cigarettes on time, please supply an address that will have an adult present when our product is delivered. If an adult is not present, notification will be left at your door so you can pick it up.

Product Return:

If you decide our product is not for you simply give us a call at 888-217-9026 no later than 11:59 P.M. ET (Eastern Time) on or before the 14th day from your original ship date as reflected on the invoice and shipped email sent to you. We will give you an RMA number to affix to the package. The RMA number has to be on the package, on the same side as the sending and receiving address. If for some reason you are unable to call us to receive an RMA #, please print and sign the "RMA Form" on the left side tool bar on the home page and mail that back with your return prior to the 14th day from your original ship date as reflected on the invoice and shipped email sent to you. All components from the original package, in their original condition, must be included to receive a refund! Refunds will not be given on packages marked "Return To Sender" or returned without a valid RMA attached. Since we cannot re-use opened consumables such as cartridges, cartomizers, atomizers, e-liquid, etc., we will deduct the list price of each listed on the product page if returned opened or tampered with in any way. Any other missing or damaged/unusable components will be charged per our price list on the Products page located on DirectECig.com. All returned products must be sent postage prepaid and post marked within 3 days of a RMA being issued by Direct E-Cig to be considered for a refund.

Direct E-Cig Money Saver Plan:

In order to offer you the best price on your cartridges and insure an uninterrupted supply, if you enroll in the Money Saver Plan you will start receiving monthly shipments beginning 30 days from the date your original kit was shipped. The quantity you are shipped and billed for every month is determined by the number of cigarette packs you currently smoke. Our minimum quantity is 30 cartridges plus 1 atomizer per month for a total cost of $59.95 plus shipping and handling. Each additional add-on of 30 will be billed at $59.95. If your vaping habits change and you want to adjust the number of cartridges you receive, please call customer service at 888-217-9026 and tell us what we can do for you. The Direct E-Cig Money Saver Plan will remain in effect until such time you contact customer support to cancel your enrollment.

If you wish to cancel your enrollment for future deliveries of the product you must call 1-888-217-9026 prior to your next monthly shipment. PLEASE NOTE THAT THERE ARE NO REFUNDS ON THE CARTRIDGES ONCE SHIPPED- NO EXCEPTIONS.

Risk of Loss:

Any item purchased or supplied by Direct E-Cig is made pursuant to a shipment contract. This means the risk of loss and title for these items passes to the buyer upon delivery to the carrier. The buyer trusts that Direct E-Cig will provide a secure method of shipment. All products containing nicotine solution are shipped out Adult Signature required but products that do not contain nicotine are shipped with delivery confirmation. Tracking numbers will be supplied at your request.

Severability:

If any provision of these Terms are deemed unlawful, unenforceable or voided then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.

Disputes:

Any and all disputes arising from use of Direct E-Cig products or purchases made through Direct E-Cig must be submitted to confidential arbitration. Any dispute will be construed, interpreted, and governed by the state unless you have violated or threaten to violate Direct E-Cigs intellectual property rights then we may seek relief in any state or federal court and you consent to exclusive jurisdiction and venue in said courts. Arbitration shall be conducted under the rules of the American Arbitration Association and all decisions and/or awards handed down by the arbitrator shall be binding and enforceable in a court of competent jurisdiction.

Lifetime Warranty:

Direct E-Cig Lifetime Warranty applies to all active Direct E-Cig Money Saver Plan subscribers and only covers the battery and wall charger included in the original starter kit. Consumable products are not covered under this warranty. For all other warranty information please see Limited Product Warranty.

Limited Product Warranty and Liability:

Direct E-Cig warrants for a time period of 90 days from the original purchase date that the products included are free from material defects and workmanship. This warranty does not apply to disposable items such as atomizers, cartridges, etc. If material is found to be defective from our company we will repair or replace with a comparable component. If damage arises from use of our product, the only recourse and maximum liability may be repair or replacement of your item originally purchased from Direct E-Cig. There are no implied warranties with Direct E-Cig.

The warranty will not apply if the product is:

  • Used with incompatible products
  • Used for commercial purposes
  • Modified or tampered with in any way
  • Damaged by wear and tear, improper use, abuse, negligence, accident, acts of god or by any cause other than defective material or workmanship.

This warranty does not cover consumable items such as cart-o-misers or products sold "as is". Warranty may be voided if Direct E-Cig believes the products contained have been used in violation of the terms and conditions or in any violation of our guidelines. The warranty will be void if products are used with products not licensed or sold by Direct E-Cig. The user assumes all responsibility for use with third party products. Valid proof of purchase such as bill of sale with the date of original purchase must be presented to obtain warranty services. Services are provided "as is" unless otherwise stated without express or implied warranty.
